LEGAL DESCRIPTION:  LOTS 27 AND 28, BLOCK l, HORNE'S SUBDIVISION, SECOND FILING, CITY AND COUNTY OF DENVER, STATE OF COLORADO

The City and County of Denver brought an administrative action against the owner of the property located at 4411 Cherokee St, Denver, CO 80216 (the “Cherokee Property").  The administrative action was brought pursuant to the City's Neglected and Derelict Building Ordinance, Article IX – Neglected and Derelict Buildings, DRMC Sec. 10-138 (a) et seq.  Following a Judgment in the administrative action, the City and County of Denver filed suit against the owner in Civil Action No. 2018CV30720, Denver District Court, then filed a motion for the appointment of a receiver over the Cherokee Property.  

On May 2, 2018, the Denver District Court entered an Order appointing Sterling Consulting Corporation as receiver over the Cherokee Property and certain rights associated with the Cherokee Property.  

The Cherokee Property is comprised of one residential building containing two dwelling units.  The owner of record passed away.  No heirs or representatives of the owner of record have identified themselves and it is too late for a Probate Action.  It is likely that the receiver will sell the Cherokee Property by receiver's judicial sale through the Receivership Estate, and that the Cherokee Property will be remediated after the sale pursuant to an agreement among the City of Denver, the buyer, and the receiver.
