The City and County of Denver brought an administrative action against the owner of the property located at 3351 West Center Avenue, Denver Colorado, 80219 (the "Center Property"). The administrative action was brought pursuant to the City’s Neglected and Derelict Building Ordinance, Article IX - Neglected and Derelict Buildings, DRMC Sec. 10-138 (a) et seq. Following a Judgment in the administrative action, the City and County of Denver filed suit against the owner in Civil Action No. 2016CV32061, Denver District Court, then filed a motion for the appointment of a receiver over the Properties. At a hearing on August 5, 2016, the Denver District Court entered an Order appointing Sterling Consulting Corporation as receiver over the Center Property and certain rights associated with the Property. On August 29, 2016, the District Court entered a formal, written Order Appointing Receiver (Sterling Consulting Corporation) nunc pro tunc August 5, 2016. The Center Property is comprised of one residential building containing two dwelling units. It is likely that the current owner of the Center Property will remediate the Center Property and sell it either through the Receivership Estate or after termination of the Receivership Estate, provided funds adequate to pay all Claims against the Center Property have been deposited with the receiver.
